原干部被控强奸演员获刑 当事人24年后承认诬告

　　原武威市文化馆干部裴树唐因“强奸女演员”被武威两级法院一、二审判处有期徒刑7年，但在裴树唐历时2 4年的不断申诉下，昔日的“受害人”因受良心谴责而坦承被人操纵对裴树唐诬告，致使该案发生了戏剧性的变化 ，并再度引起外界的强烈关注。

　　7月20日，记者从武威市中级人民法院获悉，曾轰动一时的原武威市文化馆干部裴树唐强奸业余女演员一案 ，将于7月21日上午在武威市中级人民法院再审。

　　记者了解到，原武威市文化馆干部裴树唐现年66岁，祖籍山东省平塬县，原系中国曲艺家协会甘肃分会会员 、中国民间文艺研究家协会会员、甘肃群众文化学会会员、武威市文化馆文艺辅导干部。1986年8月5日下午 3时许，裴树唐召集部分文艺骨干，在自己的办公室研究安排参加9月份职工业余文艺调演的有关事宜。会后，业 余歌手刘慧芳(化名)在练唱时存在吐字归音和气息方法上的错误，裴树唐为其单独做业务辅导，时至下午7时许 结束，刘即告辞回家。事隔9天后，刘慧芳在其未婚夫的陪同下，突然以强奸罪对裴树唐进行控告。1986年8 月30日，裴树唐被执行逮捕。1986年12月17日，原武威市(今凉州区)人民法院一审认定，当日下午裴 树唐乘其他人下班后，对青年演员刘慧芳起歹意，紧锁房门对刘进行了强奸。法院认为上列事实由证人、受害人证 言证实，法院一审判决裴树唐犯强奸罪，判处有期徒刑7年。不服判决的裴树唐上诉于原武威地区(今武威市)中 级人民法院，法院二审驳回上诉，维持原判。
