　　死者小吴2009年3月到汪某的酒吧做保安。2010年7月2日上午，汪某突然打电话给他，说自己在常 平一家西餐厅出事了，让他赶来帮忙,太阳城。小吴接到电话告诉自己老婆一声后就匆忙出去了。一个小时后，小吴的妻子接到电话得知小吴出事并已被送往医 院。待其赶到医院后，小吴已经停止呼吸。

　　小吴的妻子认为，汪某对丈夫的死有不可推卸的责任，但是汪某只给尸体火化费，于是她将汪某告上了法院。 汪某却认为，小吴是在非工作时间和工作地点与他人打架而死亡，纯粹因其个人行为造成，与其所从事的工作无关 ，所以自己不应当承担责任。

　　事发非工作时间但存在雇佣关系

　　东莞市第三人民法院经审理后认为，虽然事发时并非上班时间，小吴也不是在履行工作职责时被砍死，但汪某 在其人身安全受到威胁时要求他来保护的行为属于汪某的个人行为，应认定为汪某个人临时雇佣小吴保护其人身安 全，双方之间存在雇佣关系。

　　按照法律规定，雇员在从事雇佣活动中遭受人身损害，雇主应当承担赔偿责任。故汪某应当对小吴的死亡承担 赔偿责任，最后法院判令汪某向小吴的家属支付死亡赔偿金等各项损失共计246252.57元。
