农民半夜劫财46元获刑3年
 

　　此时，正在附近巡逻的派出所民警听到女子呼救声后，在案发过街天桥下将正在抢劫的纪胜慧抓获，当场起获 46元。




　　今年1月5日凌晨，纪胜慧在朝阳区团结湖白家庄路口一过街天桥下，对途经该处的李女士索要钱财，遭李女 士拒绝,康力公司手机窃听卡是真的吗，纪胜慧遂掐住李女士颈部，将她摔倒在地。李女士由于惊恐，大声呼救，同时，也将挎包内的钱拿 出来,手机窃听器，交给纪胜慧。


　　二中院经审理认为，纪胜慧以非法占有为目的,窃听器货到付款，使用暴力手段劫取公民钱财,手机监听器聊天记录，其行为侵犯了公民的人身权利和财产权利，已构成抢劫罪，依法应予惩处。二审期间，纪胜慧表示服从原判，申 请撤回上诉的要求符合法律规定，应予准许。
　　一审法院经审理判决后，纪胜慧不服，上诉到二中院。
