男子疑被女子骗钱骗感情持刀伤两人
 

　　阿良庭上辩称其当时只是想教训两名被害人，并没有想过要杀死他们，不构成故意杀人罪。对此法院经查认为 ，阿良于案发当日携带事前准备好的西瓜刀进入唐某陈某所处的出租屋，行凶时用刀砍被害人的脑部、脸部、颈部 等要害部位，足以认定其具有杀死被害人的故意。

　　2010年8月30日晚7时许，阿良发现唐某和陈某在广州市番禺区的一出租屋内,手机窃听器价格，遂携带一把西瓜刀将两人砍伤。被害人唐某、陈某被砍身体多处受伤，唐某面部单个创口长度超过3.5厘米。 经法医鉴定，唐某、陈某的伤情分别为轻伤、重伤。



　　阿良供称，其于2009年3月认识了在发廊洗头的唐某,手机窃听器是真的吗，唐某曾多次向其借钱作生活费,窃听卡价格，据其称共计7000元。案发当晚，其碰见唐某和一个陌生男子在一起。怀疑唐某一直骗其钱和感情的阿良便怒 上心头。

　　法院认为，阿良持刀故意杀人，已构成故意杀人罪，但鉴于其在犯罪过程中,无线手机监听器，因意志以外的原因未能得逞，是犯罪未遂，可以比照既遂犯从轻或减轻处罚，故作出如上判决。
