　　本报讯 (记者王纳 通讯员高勋、李淑颖)家族式的涉黑团伙经常见，但像这个涉黑团伙却仍然让人大吃一惊！一名18岁少年组建了 主要成员为初高中学生的帮会打架、抢劫，而其44岁的母亲不仅不予制止，反而为儿子购买枪支，参与帮派活动 ，并收取帮费用以自己和儿子的日常开支。

　　近日，上述由福田区检察院提起公诉的许某某、张某某、彭某某等人涉嫌抢劫，杨某某(许某某的母亲)涉嫌 非法持有枪支案二审判决，维持原判，两母子均获刑。

　　案情简介：

　　不良少年建涉黑团伙 老妈竟“撑腰”

　　案情显示，1993年出生的被告人许某某组建了一个名为“血�”的帮派，主要吸收未成年的在校初、高中 学生，也有小部分游手好闲的社会不良少年。

　　该帮派组织严密、分工明确，许某某自任帮主，帮主下有“五大元老”，“元老”下有“小弟”，“元老”、 “小弟”等帮派成员分不同级别每月缴纳100~150元不等的帮费并登记造册，帮派制定有帮规，并刻制了“ 深圳市血�有限公司”的印章。

　　若帮派成员与外面的人产生矛盾时，由许某某带领去打架、摆场；作案时由帮派成员分别寻找目标、提供作案 工具。

　　典型个案：打劫报复前 先要进行演练

　　2010年清明节前，在本市某学校内，被害人史某不小心撞到了许某某的女友，且许某某以为史某打其的小 报告，便对史某心生怨恨，产生了教训史某并抢劫财物的想法。

　　2010年4月4日，被告人许某某纠集其帮派的成员被告人张某某(15岁)、彭某某(19岁)、李某某 (15岁，已另案处理)共同策划了教训、抢劫史某的计划，并作了明确分工，由被告人许某某提供作案刀具并负 责接应，李某某以玩耍为由将史某骗至偏僻位置，被告人张某某、彭某某则持刀进行威胁，劫取史某的财物。随后 几人进行了演练，演练期间许某某的母亲杨某某也在家。

　　次日15时许，被告人许某某、张某某、彭某某以及李某某、杜某某(18岁，已另案处理)按照上述计划， 在福田区某栋楼楼梯处,Mbt Unono Shoes (http://www.mbt-all.com/mbt-men-shoes-mbt-unono-shoes-c-35_70.html)，持刀劫取了被害人史某的1部诺基亚型手机(经鉴定，价值人民币1845元)及1部 三星牌小灵通手机(价值未能鉴定)。

　　两母子均获刑

　　一审法院最终认定：被告人许某某(儿子)犯罪时未满十八周岁，其抢劫行为社会危害性较小，且被害人及其 家属已对其表示谅解，且是初犯，最终判处有期徒刑一年六个月，缓刑两年，并处罚金500元；被告人张某某犯 罪时未满十六周岁，归案后如实供述，认罪态度好，且是初犯,Mbt Boost Shoes (http://www.mbtshoespower.com)，判处有期徒刑一年六个月，缓刑两年，并处罚金500元；被 告人彭某某犯罪时未满十八周岁，是在校学生，在本案中的作用相对较小，且归案后有立功表现，法院对其免予刑 事处罚；而被告人杨某某(母亲)犯非法持有枪支罪，判处有期徒刑八个月。
