青年输血感染艾滋索赔无果 摔医院电话获刑1年

　　南都讯 记者马金瑜 发自北京 昨日，河南艾滋病人田喜(本报曾在2010年10月27日报道)，因故意毁坏财物罪被判有期徒刑一年。在判 决后，田喜仍像第一次开庭审理时一样选择了上诉。

　　24岁的田喜年仅9岁就因输血感染了艾滋病，后于2004年当地的艾滋病普查中检查出艾滋病(同时合并 有丙肝和乙肝)，2005年进入北京城市学院读书。6年的上访过程中，田喜在地方政府、部委与法院之间徘徊 了6年，他的经济赔偿要求始终没有得到彻底解决，当地法院也不予立案。

　　直到2010年7月底，收到新蔡县县委书记要求他回乡解决的短信后，田喜赶到新蔡。在未见到县委书记的 情况下，田喜找到作为当年输血方的新蔡县人民第一医院(认为其14年来从未给予任何赔偿)，在与院长李俊洲 谈话的过程中，田喜把办公室的电话、传真机等摔了，三天后又打掉了办公室的门扳手。2010年8月17日， 田喜被当地公安机关从家中带走。

　　宣判之前，田喜故意毁坏财物案审理的期限一再延期，并且曾中止审理。

　　在狱中，田喜的艾滋病治疗由上蔡县艾防办负责。2011年1月，由于田喜的身体情况，梁小军律师就曾向 新蔡县人民法院提出取保候审的申请，未得到批准。之后，梁小军律师又向新蔡县人民法院呼吁无条件释放田喜， 但没有回音。
